Project Summary

The global financial crisis has revealed significant weaknesses in global governance mechanisms (systems of control and regulation). This crisis is not primarily rooted in ineffective corporate governance, but mainly in the instability of markets. So far, little is known about whether and how contractual behavior can affect global systems of control and regulation. Therefore, the research agenda of contract governance aims at applying the governance approach to contract law. Prof. Dr. Florian Möslein, who is also Professor of Civil Law, German and European Business Law at the Philipps-University Marburg, focusses his research at the Munich Center on Governance (MCG) at the Ludwig-Maximilians-University on questions of Contract Governance. As a Schumpeter Fellow he is head of a research group on this topic. In addition to contractual relations, the research of this group focusses on market regulation more generally. The research group organizes various conferences and workshops in order to discuss its new insights in an interdisciplinary perspective with social and political scientists and economists.
